Minimum Age
You agree that you are 18 years of age or older from date of affiliate signup. You agree that your participation in the Scott System Design affiliate program does not violate any laws, ordinance, regulation or standard.

Representations
You agree that you will not in any ay make any representations, promises, warranties or other statements about Scott System Design or the Scott System Design web site, products or policies unless given written permission by Scott System Design.

Amendments
You agree that Scott System Design may amend this agreement at any time without notice to you. You agree to keep advised of any changes to this agreement by checking the Scott System Design web site on a periodic basis.

Customers of Scott System Design
Scott System Design will have the sole right and responsibility to service all customers through Scott System Design services. All dealings with customers for service shall be directly and solely between Scott System Design and the customer. Scott System Design shall has the rights to determine all pricing and product offerings and shall make changes without notice to affiliate. All customers are the responsibility of Scott System Design and not of the affiliate. YOU ARE IN NO WAY RESPONSIBLE FOR THE CUSTOMER ONCE THEY HAVE SIGNED WITH SCOTT SYSTEM DESIGN.

Commission Rate
Commissions are paid on a one-time basis for each new account purchased via your coded URL subject to the terms and conditions set forth herein. There will be no obligation to pay any other commission. The current commission rate for a first tier affiliate sale is based on the product as well as the billing cycle of the purchased product.

Commissions vary based upon service / product customer has signed up for and the cost for that service / product. Below are examples of typical benifit (The following is an example only).

Commissions for on new accounts only (previous or current customers are not eligible). Renewals do not qualify for commissions. Commissions are finalized until it becomes a "Finalized Commission" (see bleow).

Qualified Commission
A "Finalized Commission" is one for which the new account has remained in good standing continuously for at 30 days from becoming a customer. " If at any time after commissions have been awarded and/or paid and the affilates reffered customer's account is cancelled or terminated, for any reason, Scott System Design reserves the right to subtracte the cost of the paid commision from any future commissions you may receive.

Payment Date Payments will only be paid 30 days after your referred customer has remained a customer for 1 month (30 days).

Payment Form Commissions can be paid in two ways. By an Scott System Design check or through a PayPal account.

Checks are sent to the address you provide at registration. Any changes to this address must be sent via email to Scott System Design . Scott System Design is not liable or responsible for any cost associated with accepting or processing checks.

For payments to be made through PayPal, you must provide us with your PayPal ID as well as your affiliate username.

Tax Regulation
Due to the tax laws though the Internal Revenue Service (IRS), the United States Department of Treasury requires that every individual or corporation who is receiving affiliate commissions must submit a completed and signed W8 or W9 form. Before we can conduct affiliate payouts, we must have the completed and signed form in our possession and made available to IRS. You may download a blank W8 document here, or a blank W9 document here.

The W9 form is for US residents whereas the W8 form is for international affiliates. To avoid any delays in your affiliate payments, please submit the appropriate document, properly filled out and signed, to one of the following resources:

Property Ownership
Each party to this agreement shall retain all right, title and interest in its names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology, including, without limitation, those names, logos, trademarks, service marks, trade dress, copyrights and proprietary technology currently used or which may be developed and/or used by it in the future.

License
Scott System Design grants you as an affiliate a revocable, non-exclusive, worldwide License to use, reproduce and transmit the Scott System Design logos, trademarks and service marks on your site and only your site only for facilitating a link between your site and Scott System Design for the purpose and intent of this affiliate agreement.

Cease use upon Demand
You agree to immediately cease the use of any mark upon request made by Scott System Design to the email address provided by you and maintained on file for you by Scott System Design. You agree to immediately cease the use of any link created by you to Scott System Design upon request by Scott System Design to the email address provided by you and maintained on file for you by Scott System Design.

Effect upon Commission
Either party may terminate agreement at any time without writing notice to the other party.

Breach of this Agreement
The breach of this agreement, is grounds for immediate suspension or at the sole option of Scott System Design termination of this agreement in its entirety.

Suspension
Suspension means the Scott Systm Design may withhold all commissions qualified or otherwise until such suspension is lifted.

Upon termination of this agreement all rights and licenses granted by agreement are immediately revoked.

Non-Infringment
You agree that you will not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy.

Violation of Law
You agree to that you will not violate any applicable law, ordinance, regulation or standard.

Terms of Service
You agree to be bound by all terms and conditions of this document for as long as you remain a affiliate with Scott System Design.

Unsolicited Email
You agree not to solicite emails or send spam emails to potenial customers in relation to the Scott System Design Affiliate Program.

Decency
You agree that you will not transmit any information which is or might be considered to be lewd, pornographic or obscene.

Unfair Competition
You agree that you will not use false advertising to lure customers for the Scott System Design Affiliate Program.

Warranty Disclaimer
YOU ACKNOWLEDGE AND AGREE THAT ANY SERVICES OR MATERIALS PROVIDED BY Scott System Design PURSUANT TO THIS AGREEMENT ARE PROVIDED AS IS, WITH ALL FAULTS, AND THAT Scott System Design MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AND SPECIFICALLY DISCLAIMS, ON ITS OWN BEHALF ON AND BEHALF.

Independant Contractors
Each party shall act as an independent contractor and shall have no authority to obligate or bind the other in any respect.

Choice of Venue
This Agreement has been made in and shall be construed and enforced in accordance with the laws of the state of Florida.

Scott System Design reserves the right to change or modify these terms with no prior notice.
